The "1-in-3" Rule
You must have worked for the company (outside the U.S.) for at least 1 continuous year within the 3 years immediately preceding your U.S. entry.

Manager or Executive
You manage professionals (engineers, accountants) OR you manage an essential function (e.g., VP of Marketing) at a senior level.

The "Doing Business" Catch
Your U.S. office cannot be a "shell." It must have been active and doing business for at least 1 year before filing EB-1C.
